Legal Review of Restrictions on Women’s Mobility and Mandatory Guardianship Requirements:

Statement

Statement:

The Dialogue Hub for Common Ground expresses concern regarding restrictions on women’s freedom of movement, including compulsory male guardianship requirements and dress enforcement policies.

Applicable Legal Framework:

  • UDHR, Article 13 – Freedom of movement
  • ICCPR, Article 12 – Liberty of movement
  • CEDAW, Article 15(4) – Equality before the law in freedom of movement
  • UDHR, Article 2 – Non-discrimination

Legal Characterization:

These measures constitute:

  • Gender-based restriction of liberty rights
  • Disproportionate interference with personal autonomy

·       Potential systemic denial of equal legal capacity for women Proportionality Assessment:

Under international human rights law, restrictions must satisfy:

  • Legality
  • Necessity
  • Proportionality

The current framework fails to demonstrate adequate proportionality under ICCPR jurisprudence standards.

DHCG Position:

The Dialogue Hub for Common Ground recommends inclusion of this issue in:

  • UN Human Rights Committee state review process
  • Special Rapporteur on violence against women mandate
  • Periodic Universal Periodic Review (UPR) escalation
